Step-by-step guide
- Save the records. Download the decision report, tender documents, technical specification and a copy of the submitted bid.
- Find the grounds. Note the specific clause in the decision report and the procurement requirement against which the committee assessed the bid.
- Check what was actually submitted. Make sure the required file was uploaded, could be opened and related to the correct lot.
- Separate procedural and technical grounds. Signature, validity and document format issues need one type of evidence; product specifications, experience or licensing issues need another.
- Identify your options for challenging the decision. Check the current procedure and deadlines on the portal and in the applicable regulations. Do not use deadlines from old templates.
- State the requested remedy. Link each argument to a document and a requested action, rather than a general assessment of the decision.
Common mistakes
- Filing an appeal without a saved copy of the bid and decision report.
- Referring to a document that was not included in the bid.
- Combining several rejection grounds in one general paragraph.
- Citing unverified circumstances instead of evidence.
- Using an outdated deadline or filing procedure.
When an external review helps
If there are several grounds, time is limited or the dispute concerns the technical specification, an independent review helps distinguish a correctable error from grounds for an appeal.
